Nirbhaya case: Supreme Court dismisses curative petition of convict Pawan Gupta

New Delhi/UNI: The Supreme Court on Thursday dismissed a curative petition filed by Pawan Kumar Gupta, one of the four convicts in Nirbhaya gangrape and murder case.

Convict Pawan had filed the curative petition in the Apex Court, claiming that he was minor at the time of crime in 2012. He also argued that the lower courts had ignored this fact challenging his death sentence.

A six-judge bench of the apex court comprising of Justices N. V. Ramana, Arun Mishra, R. F. Nariman, R. Banumathi, Ashok Bhushan and A. S. Bopanna dismissed the petition stating that, "The application for oral hearing is rejected. We have gone through the Curative Petition and the relevant documents. In our opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra vs. Ashok Hurra & Another, reported in 2002 (4) SCC 388.

Hence, the Curative Petition is dismissed."

Fresh warrants for the hanging of four convicts — Mukesh Kumar Singh, Pawan Gupta, Vinay Kumar Sharma, and Akshay Kumar — in Tihar Central Jail have been issued by a Delhi court. They are scheduled to be hanged at 0530 hrs on Friday.
