Android case: SC refuses to modify NCLAT's order upholding CCI's penalty on Google

New Delhi: The Supreme Court on Friday rejected Google’s plea to modify its January 19 order in a case of unfair and anti-competitive practices related to Android devices, media reports said.

On January 19, the SC didn’t grant interim relief to the tech giant against NCLAT order upholding the Competition Commission of India’s (CCI's) penalty of Rs 1,337.76 crore pertaining to the allegations of unfair and anti-competitive practices related to Android devices.

A Supreme Court bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala said the bench can at the most add "without prejudice" in the January 19 order and nothing more.

The bench said the company can raise its grievances during the hearing of its appeal before the NCLAT.

Google’s counsel senior advocate said some portion of the January 19 order needs to be deleted.

However, the court said it wouldn’t order a deletion of any part of the judgment and asked the company to raise all these grievances during the hearing of the appeals.
