Supreme Court issues notice for examination of Triple Talaq law passed by Modi govt.
New Delhi,Aug 23 (IBNS): The "Triple Talaq" law abolishing instant oral divorce by Muslim men enacted last month by the Modi government after a lot of hurdles in Parliament will be be examined by the Supreme Court, according to a notice issued by it in response to the petitions against the law by Muslim bodies.
The apex court has sent a notice to the government in this regard, media reports said. The court issued notice following three petitions challenging the Constitutional validity of Muslim Women (Protection of Rights on Marriage) Act, 2019 which makes Triple Talaq a criminal offence.
A Bench of Justices NV Ramana and Ajay Rastogi heard the petitions by Samastha Kerala Jamiathul Ulema, Sayyed Farooq and Jamiat Ulama-i-Hind, said reports.
Reports said senior Congress leader and legal practitioner Salman Khurshid on behalf of the Muslim bodies said the law could negatively impact the wife.
After facing a hurdle in the Upper House in the previous government of Modi, the contentious Triple Talaq bill finally passed the test of the Rajya Sabha on July 30 amid walkouts by various political parties which brought down the majority mark.
The bill, which ends the practice of Muslim men divorcing their wives instantly by uttering "talaq" thrice, was passed with 99 lawmakers voting in its favour while 84 voting against it.
It criminalises instant divorcing of wives by Muslim men.
According to the new law, Muslim men could face jail for triple talaq practice.
The Opposition questioned how would the Muslim men pay their wives if they go to jail.
Though the BJP ally Janata Dal (Secular) opposed the bill, its walkout in upper house along with few other Opposition parties of the Rajya Sabha brought down the majority mark enabling the NDA to have a smooth sail in the House.
The YSR Congress Party and Congress are among several opposition parties that are opposing the bill in its current form.
Shortly after the Rajya Sabha passed the bill that had been pending for 19 months, Prime Minister Narendra Modi referred to "Triple talaq" as a "historic wrong done to Muslim women" and expressed joy that it had been confined to "the dustbin of history".
In a tweet, Modi said: "An archaic and medieval practice has finally been confined to the dustbin of history! Parliament abolishes Triple Talaq and corrects a historical wrong done to Muslim women. This is a victory of gender justice and will further equality in society. India rejoices today!"
