New Delhi/UNI: Chief Justice of India (CJI) S A Bobde recused on Tuesday from hearing a plea filed by Akshay Kunar Singh, one of the convicts in the Nirbhaya case, seeking review of the death penalty.

The three-judge bench of the Apex Court, headed by CJI Bobde and also comprising Justices Ashok Bhushan and R Banumathi was scheduled to the petition filed by one of the convicts, Akshay Kumar Singh, in the brutal December 16, 2012 gangrape and murder case.

Now, the CJI, will constitute a new bench, which will hear the matter on Wednesday at 1030 hours.

Singh has filed the review petition recently challenging the Apex Court's earlier order which had dismissed his appeal against the death penalty.
