Supreme Court rejects bail plea of teen accused of killing 7-yr-old boy in a Gurgaon school

New Delhi/IBNS: A three-judge bench of Supreme Court on Thursday rejected the bail plea of a teenager accused of killing a 7-year-old boy at a private school in Gurgaon in 2017, said media reports.

The bench headed by Justice RF Nariman dismissed the plea filed by the accused challenging the Punjab and Haryana High Court’s order which had rejected his bail plea in June last, the reports said.

In its order, the High Court had said it was not inclined to grant any relief to the petitioner since the Supreme Court had directed on February 28, 2019 that the petitioner be treated as an adult and in light of the apex court’s decision there was little scope for it to explore whether the petitioner could be granted the relief under Section 12 of Juvenile Justice Act

The Supreme Court dismissing the Special Leave Petition said since the accused is being tried as an adult for the purposes of bail plea, it saw no reason to interfere with the impugned judgment of the high court, said media reports.

The CBI opposed the bail plea saying that the accused does not deserve any leniency and Juvenile Justice Act cannot be used as a ruse to mislead the court of justice, reports said.

Appearing for the victim’s father, Advocate Sushil Tekriwal also requested the court to reject the bail plea saying that the accused can be a serious threat, the reports added.

The CBI had said the accused had killed the 7-year-old student within the school premises on September 8, 2017, in a bid to postpone the exams and cancel a scheduled parents-teachers meeting.
