Pakistan has not fulfilled obligations related to ICJ judgment in Kulbhushan Jadhav case: MEA
New Delhi: The Indian government on Thursday said Islamabad has failed to fulfill its obligations on the implementation of the ICJ judgment in letter and spirit in the Kulbhushan Jadhav case.
"It has not yet addressed the core issues, which includes provision of all documents related to the case, providing unconditional and unimpeded consular access to Shri Kulbhusan Jadhav and appointment of an Indian lawyer or a Queen’s counsel to ensure free and fair trial," said Ministry of External Affairs spokesperson Anurag Srivastava during a regular briefing.
Indian Navy officer Kulbhushan Jadhav has been sentenced to death by a Pakistani military court on alleged charges of spying.
The Islamabad High Court last month had said Indian officials should be provided with another chance to appoint a lawyer for Kulbhushan Jadhav.
The decision came after India had accused Pakistan of blocking all chances of legal remedy for Jadhav.
Earlier Pakistan had placed the International Court of Justice (Review and Reconsideration) Ordinance, 2020, in Parliament for approval.
The ordinance, according to the Pakistani media report, will have an overriding effect as its provisions shall have effect notwithstanding anything to the contrary contained in any law for the time being in force, including the Pakistan Army Act 1952.
The External Affairs Ministry of India had said the inadequacies and shortcomings in the said ordinance had been already conveyed to Pakistani authorities in June 2020, including a considerable delay in informing India about its promulgation.
