Battle for Bihar throne reaches court, two separate petitions filed in Patna HC
As per media reports, two separate petitions were filed in the Patna high court on Thursday against the “unconstitutional” move to allow Nitish Kumar form government despite the RJD being the single largest party.
The first petition was filed by one Jitendra Kumar while another was filed by RJD lawmaker Saroj Yadav and Chandan Kumar Verma.
In the petition, it has been said the grand alliance was given the mandate for five year and it was against the BJP.
It added the RJD being the single largest should have been invited to form government in the state but the governor in total violation of constitutional norms invited the JD-U to form government.
“Hence, the new government is illegal and must be dismissed,” it said.
RJD chief Lalu Prasad too raised similar question while talking to the media in Ranchi today.
“The RJD being the single largest party should have been invited first by the governor to form government in the state. If we have failed, the other party should have been given the chance and if they too had failed then the President’s rule should have been clamped but this established precedent was not followed in this case,” alleged RJD president Lalu Prasad.
