No stay on Bhabanipur bypoll where Mamata Banerjee contesting: Calcutta HC

Kolkata/IBNS: The Calcutta High Court Tuesday dismissed a plea seeking cancellation of the upcoming Bhabanipur byelection, where West Bengal Chief Minister Mamata Banerjee is contesting as a Trinamool Congress (TMC) candidate to continue with her post, media reports said.

A Public Interest Litigation (PIL) was filed questioning the Election Commission of India (ECI)'s contention of a "constitutional exigency" for holding the byelection.

The poll body said the petitioner has mischaracterized the meaning of the term "constitutional exigency".

The court Tuesday called West Bengal Chief Secretary's letter to the poll body urging for the byelection "inappropriate".

The by-election to Bhabanipur assembly seat is scheduled on Sept 30 and the votes will be counted on Oct 3.

The bypoll was necessitated following the resignation of West Bengal Minister and TMC veteran Sovandeb Chattopadhyay.

Chattopadhyay resigned to pave way for Banerjee to contest and get elected to the assembly after she was defeated by Bharatiya Janata Party (BJP)'s Suvendu Adhikari in Nandigram.

Though the Nandigram result has been challenged by Banerjee in the court, she has plunged into election again to remain in the Chief Minister's post.
