SAIL files FIR against Kashmir Steel for trademark infringement

New Delhi, Apr 17 (IBNS) Continuing its ongoing crackdown against misuse of its registered trademarks and to safeguard its popular construction-grade steel brand, SAIL TMT, Central Marketing Organisation (CMO), the marketing arm of Steel Authority of India Ltd (SAIL), filed an FIR against its own authorised dealer, M/s Kashmir Steel Corporation of Jammu, late last evening.

Operating as a dealer of SAIL since 2005, M/s Kashmir Steel Corporation has clandestinely manufactured and supplied substantial quantity of spurious steel rebars illegally bearing the SAIL TMT mark for use in various projects in Jammu and Srinagar, alleged SAIL in a release.


The FIR states that the actual quantity of SAIL TMT rebars made available for retail sales by SAIL to its dealer M/s Kashmir Steel Corporation during the last one year was only 265 tonnes. However, the dealer supplied much higher quantity running into several thousand tonnes of spurious steel for use in insfrastructure projects in Jammu & Kashmir by branding it as SAIL steel.


CMO has also complained in its FIR that M/s Kashmir Steel Corporation forged its dealership certificate by extending its validity up to January 2016 though it was valid till January ’14 only. SAIL plans to take further action against the dealer, including slapping huge compensation for causing damage to the company’s reputation by misuse of its registered trademark.


It may be recalled that CMO had filed a police complaint against M/s Ramky Infrastructures of Hyderabad for allegedly stocking spurious TMT rebars bearing the SAIL trademark at its project sites in Jammu & Kashmir.

Earlier last week, CMO had also filed legal charges against one of its own conversion agents, M/s SKS Ispat of Raipur, for misusing the SAIL logo and trademark. In addition, CMO lodged FIRs against Raipur-based re-rollers M/s Pankaj Ispat and M/s Alankar Alloys, who were found to be infringing trademark laws by illegally manufacturing TMT bars bearing SAIL trademarks in their factories. Following CMO’s complaint, the owners of these two companies were imprisoned and their assets worth Rs. 7 crore seized by the Enforcement Directorate.


SAIL is determined to protect its 18 registered product trademarks and will take stringent action against any re-rollers, dealers or others indulging in manufacturing and sales of spurious steel by stamping SAIL brand names/trademarks on them.
