Calcutta High Court cancels Madan Mitra's bail, former minister ready to surrender

Kolkata, Nov 19 (IBNS): After long hearing sessions on Wednesday and Thursday at the Calcutta High Court, a division bench comprising of Justice Nishita Mhatre and Tapas Mukherjee on Thursday afternoon cancelled Madan Mitra's bail, which was granted on Oct 31 by Alipore Court.

Madan Mitra's lawyer S. K. Kapoor sought to allow 7 days time to  the former minister for surrender.

However, rejecting Kapoor's appeal, Justice Nishita Mhatre directed Madan Mitra to surrender immediately before the Alipore Court after receiving the order's copy.

After 324 days of captivity in connection with the multi-crore Saradha chit fund scam, Madan Mitra was granted conditional bail from Alipore Court on Oct 31.

Challenging the judgement of the lower court, the CBI moved to the Calcutta High Court on Nov 3, to get revoked Mitra's bail.

A division bench comprising Justice Joymalya Bagchi and Justice Mir Dara Sheko on Nov 5 put Madan Mitra under house arrest until the next hearing, which was scheduled on Tuesday.

Mitra's lawyers could not file affidavit before the apex court of the state, the division bench comprising Justice Nishita Mhatre and Tapas Mukherjee had adjourned the hearing till Wednesday.

Meanwhile, Mitra on Wednesday evening resigned from his post and sent his resignation letter to the chief minister.

WB chief minister Mamata Banerjee accepted his resignation letter and has forwarded to Governor Keshari Nath Tripathi for final approval.

Madan Mitra was under 24-hour police-surveillance from Nov 5 to Thursday.

Meanwhile, Mitra reached Alipore Court to surrender before the ACJM on Thursday evening.

However, as the copy of the Calcutta High Court's judgement did not reach Alipore Court so far, Madan Mitra has not been allowed to surrender. Till the last update came in, the ACJM and Madan Mitra are waiting for the order's copy.

All opposition parties welcomed the judgement of the Calcutta High Court. No reaction has been received so far from the ruling TMC.

While entering into Alipore Court, Madan Mitra told media, "I heard on TV that my bail had been cancelled in High Court. As I respect the honourable High Court, I am going to surrender. My health condition is not well."      

After a marathon questioning session, the CBI arrested Madan Mitra on Dec 12 last year for his alleged involvement in multi-crore Saradha financial scam.
