Delhi HC seeks Centre’s response on Subramaniam Swamy’s complaint over Rahul Gandhi’s citizenship
New Delhi: The Delhi High Court on Wednesday directed the Centre to apprise the court of the steps taken regarding a 2019 complaint by BJP leader Subramanian Swamy concerning the alleged dual citizenship of Congress MP Rahul Gandhi, media reports said.
In August 2019, Swamy wrote to the Union home ministry, alleging that Gandhi had "voluntarily disclosed" British nationality to the UK government, which he claimed violated Article 9 of the Constitution and the Indian Citizenship Act, 1955.
A bench of Chief Justice DK Upadhayay and Justice Tushar Rao Gedela asked Additional Solicitor General (ASG) Chetan Sharma to seek instructions after Swamy submitted that, despite multiple representations, he had not received any response from the government on the status of his complaint, Hindustan Times reported.
"The prayer is not to make a decision on the substantive issue of the pending matter. He (Swamy) is only seeking directions on his representation. Seek instructions regarding the stage of the proceeding, regarding the letter (August 2019 letter)," the bench stated, scheduling the next hearing for March 26, the report said.
Swamy’s plea urged the court to direct the home ministry to take action on his representation, which sought the cancellation of Gandhi’s citizenship.
He noted that while the government had issued a show cause notice to Gandhi, the Congress leader did not respond, and no further action had been taken.
Earlier, the court had expressed reservations about hearing Swamy’s plea, pointing out that a similar petition was pending before the Allahabad High Court.
That case, filed by BJP member Vignesh Shishir from Karnataka, seeks a CBI probe into Gandhi’s citizenship.
