Former police chief discharged in Sohrabuddin fake encounter case
Pandey was accused of trying to derail investigations into the encounter killing case.
The court ruled that the CBI should have taken the Centre's sanction before charging him.
According to section 197 of CRPC, government sanction is required to prosecute police officers but this was not followed in PC Pandey's case.
A 1972 batch IPS officer, Pandey was also the Ahmedabad Police Commissioner during the 2002 post-Godhra riots.
In 2005, Sohrabuddin, along with his wife Kauser Bi and Tulsiram Prajapati was kidnapped by the Gujarat police while travelling on a bus from Andhra Pradesh.
Sohrabuddin and his wife were killed a few days later. Tulsiram, a key witness to their kidnapping, was shot dead a year later; the police claimed that he was trying to escape.
Mr Pande was accused of suppressing evidence in Tulsiram's killing.
Another controversial police officer, DG Vanzara, was granted bail in the case last year.
