Nirbhaya Case: Defence lawyer moves court alleging Tihar Jail coming in way of filing mercy petition

New Delhi/IBNS: The lawyer of Nirbhay rape and murder convicts has moved the Patiala House Court alleging that Tihar Jail is causing a delay in filing the mercy petition.

The court has scheduled the hearing for Saturday next.

Lawyer AP Singh alleged that the jail authorities are yet to release the papers needed to file curative and mercy petitions for two of the convicts Pawan and Akshay.

Supreme Court has already dismissed the curative petition of the other two accused Vinay Kumar Sharma (26) and Mukesh Singh (32).

All the convicts in the case are scheduled to be hanged on Feb 1.

Meanwhile, the Centre has filed a petition in the Supreme Court seeking its direction for fixing a seven-day deadline for executing the death penalty of death row convicts. The Ministry of Home Affairs has sought a direction from the court to fix the deadline for filing of curative pleas after the rejection of review petitions.

MHA also sought direction from the apex court to set a deadline of seven days for filing of mercy petition after a death sentence is issued by a competent court.
