Relief for Centre, HC rules Lt Guv constitutional authority in Delhi
New Delhi, May 29 (IBNS): In a relief for the Centre, the High Court on Friday ruled that the Lieutenant Governor is the constitutional authority in Delhi.
The High Court said that Lt Governor will deliberate on proposal given by the Delhi government.
It has also declined the request of petitioner to change the Constitutional primacy of the Lt Governor.
Meanwhile, a notice has been given to the Centre on Delhi government's plea.
This comes after the bitter power struggle between the Centre and the Aam Aadmi Party (AAP) government in Delhi led to two court cases that was heard on Friday
Both cases- one in the Delhi High Court and the other in the Supreme Court- were related to a controversial home ministry notification that said that Chief Minister Arvind Kejriwal has limited powers in Delhi.
The High Court had, earlier this week, called the notification 'suspect' and said Lieutenant Governor Najeeb Jung, who represents the Centre, is "bound to act upon the aid and advice" of the Delhi council of Ministers.
The 'suspect' word has been challenged by the Centre in the Supreme Court, which will hear the case on Friday.
In a setback for the Aam Aadmi Party government, the Supreme Court on Friday said the Delhi High Court's observation putting a 'suspect' tag on Union Home Ministry's notification demarcating the powers of the Lieutenant Governor and the
Chief Minister should not influence further hearings.
The apex court also issued notice to the Delhi government on Centre's appeal against HC order allowing the Anti-Corruption Branch of Delhi to take action against bureaucrats.

Kejriwal earlier alleged that the ruling BJP at the Centre wants to govern Delhi by proxy, though the party has only three legislators in the Delhi Assembly as against 67 of the Aam Aadmi Party, which made a sweeping victory in the last Assembly elections.
