SC agrees to hear plea for cancellation of Nitish Kumar's House membership for concealing murder case

Patna, Aug 1 (TheBiharPost/IBNS): In a significant development, the Supreme Court on Tuesday agreed to hear a petition seeking cancellation of Bihar Chief Minister Nitish Kumar’s membership of state Legislative Council for allegedly hiding a murder case pending against him.

A bench of Justices Dipak Misra, Amitava Roy and AM Khanwilkar agreed to hear the case after it was filed on Monday.

The case has been filed by advocate ML Sharma.

Questioning  the Chief Minister's act of concealing the case from the Election Commission and then continuing in office without seeking bail despite facing such a serious criminal charge, the petitioner has sought immediate cancellation of Nitish Kumar's  House membership.

The Chief Minister  has been accused of killing  a local Congress leader and injuring four others during the 1991 Lok Sabha elections for Barh seat.

The lawyer has sought cancellation of Kumar's membership as per the Election Commission's 2002 order making it mandatory for candidates to disclose criminal cases against them in their affidavits annexed to nomination papers.
