Supreme Court raps Nitish Kumar government in shelter home cases

New Delhi, Nov 27 (IBNS): The Supreme Court has lashed out at the Bihar government for not filing First Information Reports (FIRs) on allegations of sodomy of children at shelter houses in the state, media reports said.

The top court said this while hearing a separate case of alleged rapes of several young women at the Muzaffarpur shelter home in the state.

The Supreme Court has said filing the case under Protection of Child from Sexual Offences (POCSO) and not under section 377 is not the correct way to investigate.

Though the top court has recently struck down section 377, which earlier used to criminalise gay-sex, non-consensual or forced-consent for sex still continues to be a crime.

Muzaffarpur shelter home case:

Over 40 young girls were sexually abused in the Muzaffarpur shelter home. The sexual exploitation of the girls was first highlighted in an audit report submitted by the Tata Institute of Social Science (TISS) to the state's social welfare department in April. The first case was filed on May 31 against 11 people, including Brajesh Thakur.
