New SC bench to hear 2009 contempt case against Prashant Bhushan on Sept 10

New Delhi/UNI: A new bench of the Supreme Court will hear the 2009 contempt case, in which activist-lawyer Prashant Bhushan allegedly made remarks calling half of 16 former Chief Justices 'corrupt', on Sept 10.

Apex Court bench, headed by Justice Arun Mishra on Tuesday said that since he is retiring on Sept 2, there is a paucity of time to address the questions which would require a lengthy hearing.

The bench agreed to refer to an appropriate bench the question of conflict between the right to free speech and suo moto contempt powers of the court in the 2009 contempt case against Bhushan, which was initiated for calling past Chief Justices as 'corrupt.'

Justice Mishra said, since Bhushan's counsel, Rajeev Dhavan has raised many questions, there is a paucity of time, otherwise we would have heard the senior counsel with respect to the questions which have been proposed.

"However, since the matter is pending for the last 10 years, as prayed for, we fix the date for Sept 10 before an appropriate Bench as may deem fit by the Chief Justice," the top court asserted.
