SC shifts Unnao rape cases out of Yogi Adityanath's UP; 25 lakh compensation for victim

New Delhi, Aug 1 (IBNS): Taking cognizance of the Unnao rape incident, the Supreme Court on Thursday ordered a shifting of all five cases related to the crime from Uttar Pradesh to Delhi and also ordered the Yogi Adityanath government to pay an interim compensation of Rs. 25 lakh to the victim.

The compensation will have to be paid to the victim by Friday.

Chief Justice of India (CJI) Ranjan Gogoi, who had summoned the Central Bureau of Investigation (CBI) officers at noon, asked for the completion of the trial, which will have to be carried out on a daily basis, within 45 days since its commencement. The top court has directed the CBI to probe within seven days the "accident", which was met by the rape survivor and her family last Sunday leaving her mother and aunt dead.

It was the accident which brought the case back to limelight causing a huge uproar across the nation for last four days promoting the Bharatiya Janata Party (BJP) to expel its accused MLA Kuldeep Sengar on Thursday, two years after the crime was committed. Sengar's brother is also an accused in the case.

CJI Gogoi has also said the rape victim can be shifted to Delhi if her family allows. The Central Reserve Police Force (CRPF) will be provided for the victim's security.

Accident of Unnao rape survivor

The survivor and a lawyer were critically injured while her mother and aunt were killed on Sunday when their car was hit by a truck at Sultanpur Khera roundabout in the district.

Police here said that the victims were going on a car to meet their relative at Rae Bareli jail when it was hit by a truck coming from opposite direction under Gurubakshganj police station area on Rae Bareli-Banda highway.

The people in the car were going to Rae Bareli jail, where the gang rape victim's uncle is lodged.

The rape survivor is presently on life-support but in a stable condition. 

A day after the victim and her family had tried to immolate themselves in front of Uttar Pradesh Chief Minister Yogi Adityanath's residence, the victim's father died in judicial custody allegedly by police torture.

The pressure had mounted on the BJP-led Uttar Pradesh government after the reports claimed the victim's family had appealed to the state dispensation over the threats they were receiving. 

CJI Gogoi also expressed displeasure on Wednesday after he came to know that the victim's letter did not reach him. He had also asked the Supreme Court registry why there was a delay in placing the letter by the rape victim's family before him. CJI Gogoi has also asked the registry to submit a reply as to why there was a delay within a week.

Reactions

Demanding Yogi Adityanath's resignation, the Congress in its official Twitter handle said, "We welcome the Supreme Court's orders to transfer all the cases related to Unnao rape & accident case out of UP. We hope the victim & her family will see the light of justice soon."

Immediately after the verdict, Congress' east Uttar Pradesh chief Priyanka Gandhi Vadra tweeted, "Grateful to the SC for taking cognisance of the ‘Jungle Raj’ being unleashed in U.P. Meanwhile, the BJP finally acknowledges having empowered a criminal and takes some action to correct itself and move in the direction of justice for a young woman who has suffered immeasurably."
