SP leader Azam Khan disqualified as MLA after conviction in hate speech case

Lucknow: Samajwadi Party (SP) leader Azam Khan has been disqualified from membership in the Uttar Pradesh Assembly after his conviction in a 2019 hate speech case, media reports said.

Rampur MLA Azam Khan, who is also one of the founding members of SP, was convicted in a 2019 hate speech case on Thursday. A Rampur court sentenced Khan to three years imprisonment and imposed a fine of Rs 2,000 on him.

Following his conviction, the office of UP Assembly Speaker on Friday announced that SP leader and Rampur MLA Azam Khan has been disqualified from membership in the UP Legislative Assembly, India today reported.

The SP leader has been disqualified as the Representation of the People Act says that anyone sentenced to imprisonment of two years or more shall be disqualified "from the date of such conviction" and remains disqualified for another six years after serving the jail term, it added.

As per the law, the Assembly Speaker can start the disqualification proceedings either suo motu or after receiving an application on this.

After handing out the punishment, the Rampur court granted bail to Azam Khan the case besides and allowed him time to file an appeal against the sentencing.
