Cyrus vs Tatas: NCLT tells Mistry to file rejoinder

Mumbai, Dec 22 (IBNS): The National Company Law Tribunal on Thursday did not grant any interim reliefs in the Company Petition by ousted chairman Cyrus Mistry, said Tata Sons after Mistry filed a petition against the salt-to-software conglomerate before the quasi-judicial body to either replace the company's current board, or appoint a retired Supreme Court judge as non-executive chairman.

The Tatas in a media statement said the "Parties have been directed to file replies and rejoinders in a fixed time table in January, 2017."

"The Court also ordered the Petitioner [Mistry] not to seek for any further interim reliefs in the subject matter. Tata Sons believes that the Petition is not maintainable in law and the Court will hear Tata Sons on this issue at the outset at the next hearing," it said.

Reports said the  National Company Law Tribunal has asked Cyrus Mistry to file a rejoinder within 7 days in the petition filed  against Tata Sons Ltd. and prove his allegations with material facts.

Tata Sons said it "does not wish to state any further since the matter is sub-judice."

Tata Sons' ousted chairman Cyrus Mistry has resigned from all Tata Group companies earlier.

He resigned when four of the firms were to vote on removing him as director in extraordinary general meetings or EGMs.

"It is time to shift gears, up the momentum and be more incisive in securing the best interests of the Tata group,"  Mistry said in a letter to the Board of Tata Sons and shareholders when he stepped down.

The Tata Group left the industry world stunned when on Oct 24, the Tata Sons board,ousted Cyrus Mistry as chairman. 

Meanwhile, close on the heels of Cyrus Mistry's resignation from Tata Steel board, shareholders have removed Nusli Wadia as an Independent Director of the company, reports said.

Wadia was ousted on Wednesday with more than 90 per cent of the shareholders voting in favour of his removal at an Extraordinary General Meeting (EGM).

Wadia skipped the meeting saying that it was “stage-managed.”
