Justice JP Gupta issued the ruling.

On October 27, 2018; Patra held a press conference in MP Nagar locality. Though the scheduled timings were 1300-1500 hrs, he commenced it at 1230 hrs.

Construing this as violation of the Model Code of Conduct, Election Officer LL Ahirwar had a first information report registered. The lower court issued a bailable warrant against the politician but the latter moved the High Court against it.
