Supreme Court upholds disqualification of 17 K'taka MLAs but allows them to contest by-polls

New Delhi/IBNS: The Supreme Court on Wednesday upheld the disqualification of 17 Karnataka MLAs by then Speaker KR Ramesh Kumar but allowed them to contest the upcoming by-elections due to be held on Dec 5.

Out of the 17 MLAs, 14 belong to the Congress while three were from the Janata Dal Secular (JDS).

The top court said the disqualified MLAs can hold ministries or public offices if elected in the upcoming by-polls.

The MLAs had turned rebel against the then Congress-JDS alliance government which was formed in 2018. They were disqualified by the Speaker just before the trust vote which was lost by then Chief Minister and JDS leader, HD Kumaraswamy.

The MLAs had then moved the Supreme Court.

After Kumaraswamy had lost the trust vote, the Bharatiya Janata Party (BJP) assumed power with its leader BS Yediyurappa as the Chief Minister.

The by-polls will be held in 15 out of 17 seats fell vacant due to the disqualification of the MLAs.
