Supreme Court refers Shiv Sena case to larger bench, restrains EC from action

New Delhi/IBNS: The Supreme Court Tuesday referred the case related to the claim over Shiv Sena to a larger bench, restraining the Election Commission from taking action on the party symbol now, media reports said.

A five-member constitution bench will hear the plea Thursday on the dispute between the two factions, one led by Maharashtra Chief Minister Eknath Shinde and the other by his immediate predecessor Uddhav Thackeray.

"List the matter before the constitution bench the day after tomorrow and the bench will decide about the symbol related to the Election Commission proceeding at the beginning," the bench comprising Chief Justice NV Ramana, Justices Krishna Murari and Hima Kohli said as quoted by NDTV.

Shinde last month appealed to the Supreme Court to quash all pleas filed by the Thackeray team and allow the poll body to take a call on whose faction rightfully claims the Sena.

A rebellion by 40 Sena MLAs including Shinde led to the collapse of the three-party alliance government in June, paving way for the current Chief Minister to assume the top post allying with the Bharatiya Janata Party (BJP).
