Kejriwal agrees to furnish bond, to be released from jail
New Delhi, May 27 (IBNS): A Delhi court on Tuesday ordered Aam Aadmi Party (AAP) supremo Arvind Kejriwal's release from the Tihar Jail after it accepted his bail bond filed by his advocate in a defamation case filed by Bharatiya Janata Party (BJP) leader Nitin Gadkari, reports said.
This comes after Kejriwal agreed to High Court's suggestion to furnish the personal bond first before it starts hearing him.
"Arvind Kejriwal had so far refused to furnish a personal bail bond on the principled issue that common people should not be subjected to harassment on technical grounds in courts of law in petty cases," the AAP posted on its official Facebook page.
"Kejriwal on Tuesday accepted the proposal of the hon’ble Delhi High Court to furnish a personal bail bond for his release from the Tihar Jail, and the court has made it clear that the issue of whether such bonds are a mandatory requirement, will be subject to the final outcome of his petition, listed for hearing on July 31," it said.
Senior advocate Shanti Bhushan and advocate Prashant Bhushan informed a bench of justices Kailash Gambhir and Sunita Gupta that he has agreed to the proposal and has signed a bond of Rs 10,000.
The bench asked Kejriwal’s lawyers to present the bond to the magistrate concerned or duty magistrate on Tuesday itself.
Kejriwal on Monday moved the Delhi High Court against the magistrate court order in connection with the case.
"In his petition filed in the High Court, Kejriwal has raised the issue of whether it is correct to seek bail bonds and sureties from people who are summoned by courts on complaints filed in cases like that of criminal defamation," the AAP said.
"This question will be settled by the High Court, when it will deliver its verdict on Kejriwal's petition," it said.
Amid protests Kejriwal was on last Wednesday arrested and taken to Tihar Jail by the Delhi Police after he refused to to submit a personal bond of Rs 10,000 in the Gadkari defamation case.
The Patiala House Court on Friday remanded Kejriwal to 14-day judicial custody in connection with the defamation case.
Several AAP supporters, who held protests outside the prison, were detained later.
In the court on last Wednesday, Kejriwal said that he would not give a bail bond on principle.
After his refusal to pay the bond, the judge asked him whether he was looking for exceptional treatment.
Gadkari had filed a defamation case before metropolitan magistrate in Delhi in mid-February. He had said that Kejriwal has tarnished his image by calling him corrupt.
A Delhi court on Feb 28 summoned former Kejriwal in a criminal defamation case filed against him by Gadkari.
Gadkari had slapped a legal notice on Kejriwal for including his name in the latter's "India's Most Corrupt Politicians" list.
