Two Delhi HC judges recuse from hearing plea challenging Justice D Y Chandrachud's appointment as CJI

New Delhi/IBNS: Delhi High Court Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad Friday opted out of hearing a plea that sought a review of an HC order dismissing a petition challenging the appointment of Justice D Y Chandrachud as the Chief Justice of India (CJI), reported media.

The plea also includes certain allegations against the judges, the division bench of the high court noted, adding that it cannot hear the case.

The petition will be heard by another bench on January 16, the bench headed by Chief Justice Sharma said.

On November 11, 200, the high court had dismissed the Public Interest Litigation (PIL) challenging the appointment of Justice D Y Chandrachud as the Chief Justice of India (CJI) and Rs 1 lakh towards costs on the petitioner Sanjeev Kumar Tiwari, the national president of an organisation named Gram Uday Foundation.

While dismissing the plea, the bench had said the offices held by the constitutional functionaries in public trust are not open to denigration by self-styled warriors of public interest on the basis of superficial allegations.

In his review plea, the petitioner has sought to overrule the earlier order as well as to waive the costs.

"Imposing penalty for such a petition is the most unjust and unconstitutional action of the chief justice and his companion judge. Hence the review petition is filed," he alleged, according to the report.

Justice Chandrachud took oath as the 50th CJI on November 9, 2022.
